Forum “TALK Open for the Rule of Law in Kosovo”

Prishtinë, 18 May 2022 – The FOL movement, supported by the US State Department, through the International Bureau for Narcotics and Rule of Law (INL), held the discussion “FOL Open for the Rule of Law in Kosovo”. In this discussion, the Ambassador of the United States of America Mr. Jeffrey M. Hovenier as well as the Minister of Justice Mrs. Albulena Haxhiu.

In this discussion, the findings from the report “Performance of the prosecutorial and judicial system for cases of domestic violence during 2021” were presented, while the American Ambassador made his first address regarding the field of the rule of law in Kosovo.

BEYOND THE NUMBERS – Performance of the prosecutorial and judicial system in dealing with and resolving cases of domestic violence during 2021

Pristina, May 20, 2022 – The FOL movement has continued with the monitoring of the publication of judgments from all courts of Kosovo on the web-portal of the Judicial Council of Kosovo. During the month of April 2022, the courts on the web-portal of the Judicial Council of Kosovo have published 2177 verdicts. The court with the largest number of judgments published for the month of April is the Court of Appeal with 676 judgments. Below you can see the infographics for each court and branch. Adopt the Law that opens the wallets of political parties

Pristina, 17 03 2022 – The Assembly of Kosovo is expected to examine today, among other things, the Draft Law on the Financing of Political Entities. This is the third time, namely the third legislature in a row, that this draft law goes through the legislative procedure in the parliament.

The failure to review and approve this very important law has continuously violated the transparency and financial accountability of political entities, which receive over 4 million euros from the state budget every year, as well as represents a setback in the implementation of the European Reform Agenda (ERA).

The new draft law on Financing of Political Entities largely addresses the concerns regarding the lack of financial transparency of political entities. Knowing the many failures and delays in the selection of auditors by the Assembly, by means of this draft law, the competence for the selection of auditors is transferred to the Office for Registration of Political Parties and Certification, which has been provided with a high level of functional and budgetary independence. Likewise, the contributions that political subjects can receive, as well as the sanctioning measures in case of violations, are defined. At the same time, we recall that this draft law is in accordance with the opinion of the Venice Commission as well as the demands and recommendations of the civil society.

We, civil society organizations, estimate that the further delay of this draft law is unreasonable, as well as damages the integrity of political entities and the public’s credibility towards them. We understand the different positions that political subjects may have regarding the draft law as a whole or certain parts of it, however, we request that these positions be expressed and translated into contributions during the review of the draft law between the two readings.

Therefore, we call on the deputies of the Assembly of Kosovo, both from the position and from the opposition, to vote for the approval of this draft law in principle without further delay.

We will continue providing our expertise through concrete recommendations in order to advance the draft law during the discussions in the period between the two readings. Also, we will closely monitor the work of the Assembly bodies that will be involved in the review of this draft law.

The Prosecutor’s Office and the Basic Court of Prizren with the best performance in handling corruption cases for 2021, while the Basic Prosecutor’s Office of Mitrovica and the Basic Court of Pristina with the weakest performance

Pristina, 15.03.2022 – The FOL Movement has today published the report “Performance of the Prosecution and Judicial System in the Resolution of Corruption Cases during 2021 (statistical analysis)”, which addresses the issue of the performance and efficiency of the first instance of the judicial system and that of the prosecution in the resolution of corruption cases during the period January – December 2021, as well as elaborates the workload level of these institutions in the resolution of these cases.

The report is based on the official statistical data received by the Prosecution Council of Kosovo and the Judicial Council of Kosovo for the year 2021, while to measure the performance of these institutions on the basis of these official statistics, FOL has used the methodology of the European Commission for the Efficiency of Justice (CEPEJ). The report does not include the quality of the cases, or the quality of the work of the prosecutor’s offices and courts, but only their statistical measurement.

Albana Hasani, Researcher at the FOL Movement presents the main findings of this report, some of which are listed below.

-The Special Prosecutor’s Office and the seven basic prosecutor’s offices of the Republic of Kosovo during 2021 have handled a total of 802 corruption cases, of which they have managed to handle a total of 409 cases, respectively 51% of all the cases they have handled during this year. Meanwhile, part of the 393 cases remained unresolved and were carried over to 2022.- The Special Prosecutor’s Office and the seven basic prosecutor’s offices of the Republic of Kosovo during 2021 had a total of 802 corruption cases at work, of which they managed to deal with a total of 409 cases, namely 51% of all the cases they have worked on this year. Meanwhile, part of 393 cases remained unresolved and were carried over to 2022.

-The resolution rate of corruption cases in all prosecution offices of the Republic of Kosovo for 2021 turns out to be 84%, which means that the number of cases resolved during this period was lower than the number of new cases received during the year.

– Based on the general statistical data received by the Prosecutorial Council of Kosovo, the Prosecutor’s Office that has achieved the best results in handling corruption cases during this period is the Basic Prosecutor’s Office of Prizren, which during this period has achieved the highest rate of resolution of cases (120%), the highest turnover rate of cases (4.29%) as well as the shortest time needed to resolve the cases that remained unresolved this year. In other words, out of 90 corruption cases that this prosecutor’s office has handled, it has managed to resolve 73 of them, or 81%.

– Meanwhile, the prosecutor’s office with the weakest results in handling corruption cases during 2021 (the same as in 2020) was the Basic Prosecutor’s Office of Mitrovica, which during this period achieved the lowest turnover rate of cases (0.26), the highest rate low resolution of cases (44 %) as well as the highest index of accumulated cases (2.96). In other words, out of 133 cases that this prosecutor has worked on this year, it has managed to solve only 28 of them, or only 13% of all the cases it has worked on.

– As for the number of indictments filed during this period, the seven basic prosecutor’s offices and the Special Prosecutor’s Office in 2021 had filed indictments for 335 people in connection with criminal offenses of corruption.

As for the findings regarding the judicial system, Hasani declares that:

-The seven basic courts of the Republic of Kosovo during 2021 had a total of 383 corruption cases (281 of which were inherited from the previous year and 102 new cases created during the year), while they managed to resolve only 108 cases, or 28% of all the cases they have handled.- The seven basic courts of the Republic of Kosovo during 2021 have handled a total of 383 corruption cases (281 of which were inherited from the previous year and 102 new cases created during the year), while they managed to resolve only 108 cases, or 28% of all cases they had at work. 73% of the corruption cases that were at work during 2021, namely 281 cases, were inherited from the previous years.

-The resolution rate of corruption cases in all basic courts during 2021 was 106%, which means that the number of cases resolved during this period exceeds the number of new cases created during the year.

-Based on the general statistics of the Judicial Council of Kosovo, the best results in the resolution of corruption cases during this period were achieved by the Basic Court of Prizren, which during this period achieved the highest rate of turnover of Cases (1.15), the lowest index of accumulated cases (1.13), as well as the shortest time needed to solve the cases that remained unresolved this year (317 days). In other words, out of 43 corruption cases that this court has dealt with, it has managed to resolve 23 cases, or 53% of all cases.

– While the weakest results in the handling of corruption cases during 2021 were achieved by the Basic Court of Pristina, which of the 197 cases it had at work in 2021, managed to solve only 34 of them, or only 17%. During this period, this court achieved the lowest turnover rate of cases (0.20), the highest index of accumulation of cases (4.61), as well as the longest time for the resolution of the cases that remained unresolved this year.

-In 2021, the basic courts issued 59 guilty verdicts, 26 acquittals, 4 rejection verdicts, and 19 cases were resolved in other ways. Of the guilty verdicts, for most of them, namely for 31 cases, finer sentences were imposed, while for 22 cases prison sentences were imposed and for 6 cases conditional sentences.

Performance of the Prosecution and Judicial System in the Fight against Corruption during 2021

Women not represented in local councils: out of 740 chairpersons, only 7 are women

 

Pristina, March 1, 2022 – The FOL movement with the financial support of the Rockefeller Brothers Fund held a press conference today where it published the monitoring of the report “Municipalities do not implement the Administrative Instruction of the MLGA No. 02/2019”.

FOL has monitored the level of implementation of Law No. 03/L-040 for Local Self-Government and Administrative Instruction (MAPL) no. 02/2019 on the Organization, Operation and Cooperation of Municipalities with Villages, Settlements and Urban Neighborhoods where the issue of selecting local councils is elaborated in detail.

Ardi Shatri said that “according to the administrative instruction in force, municipalities must adopt new municipal regulations for the regulation of local councils in compliance with the requirements of this administrative instruction within 6 months from its entry into force”.

Shatri said that “according to the monitoring of FOL, of the 38 municipalities of Kosovo, 14 municipalities (Prizren, Pejë, Ferizaj, Gjakovë, Mitrovica, Skenderaj, Kamenica, Hani i Elezit, Lipjan, Klinë, Kaçanik, Viti, Kllokot, Graçanicë) have published on their official websites the new versions of the municipal regulations for the organization and operation of local councils, which are in compliance with the requirements of the administrative instruction in force”.

Of the municipalities that have published the new regulations, only 2 municipalities (the Municipality of Gjakova and the Municipality of Peja) are fully implementing the new regulation in practice, he said. In addition, 13 municipalities (Deçan, Istog, Dragash, Obiliq, Leposaviq, Rahovec, Prishtina, Suharekë, Vushtrri, Gllogoc, Podujevë, Gjilan and Novobërdë) are operating with the old regulations, which are not in compliance with the administrative instruction in force. 11 municipalities (Fushë Kosovë, Partesh, Shtime, Shtërpcë, Zveçan, Zubin Potok, North Mitrovica, Junik, Mamushë, Malishevë, Ranilluge) have not published any version of the regulations.

According to Shatri, “the municipalities that have published the new municipal regulation in compliance with the requirements of the administrative instruction are the Municipality of Mitrovica, Gjakova and that of Peja”, while the municipality of Podujeva has indicated that the regulation is still in the stage of public consultation”. Meanwhile, the municipality of Gjilan has published the old municipal regulation that is not in compliance with the requirements of the administrative instruction.

Shatri said that regarding the status of the selection of local councils, according to the data sent by the responsible officials of the municipalities, out of the total of 38 municipalities of Kosovo, 18 of them (or 47%) have established local councils which are functioning normally , 8 municipalities (or 8%) have reported that the mandate of the local councils has passed, or that they have not yet been elected, while 12 municipalities (or 31%) have not responded at all about the status of the establishment and operation of the local councils.

According to data provided by FOL, of the 740 elected chairmen of local councils, 733 of them, or 99%, are men, while only 7 are women (respectively only 1%). The municipalities that have elected female chairpersons of the local councils are: the Municipality of Peja (with 3 female chairpersons of the councils), the Municipality of Shtime and the Municipality of Prizren (with 2 female chairpersons of the councils), said Shatri.

FOL recommends the Ministry of Local Government Administration to coordinate with the Association of Kosovo Municipalities regarding the approval of new municipal regulations for the selection of local councils, as well as the establishment and operation of local councils in compliance with municipal regulations, administrative instructions and the law on local self-government.

Damages to the state budget as a result of illegal dismissals of employees in the public sector

Pristina, February 22, 2022 – The FOL movement, with the support of the Kosovo Foundation for Open Society (KFOS), has published the report “Illegal dismissal of employees in the public sector – the consequences on the state budget”, where it has generally addressed the issue of illegal departures from the work relationship in the public sector, as well as the cost of the state budget as a result of these departures.

The main purpose of the report is to draw the attention of the institutions responsible for the impact and consequences on the state budget in the event of the termination of employment relationships of employees in the public sector, when the same are done not respecting the provisions of the legislation in force.

Albana Hasani, from the FOL Movement, said that a total of 128 complaints from civil servants were submitted to the Independent Supervisory Council during the year 2019 – October 2021 against decisions to terminate employment relationships at state institutions. 69 of these complaints were submitted against the decisions of the central administration (respectively 54%), while the rest of 54 complaints (or 46%) were against the decisions of the local administration.

“Regarding the decisions of the Council, it should be noted that from January 21, 2019 to October 2020, the Independent Supervisory Council for the Civil Service of Kosovo was non-functional, therefore during this period it was not possible to make any decisions in relation to the submitted requests. The malfunctioning of the Independent Supervisory Council for almost two years has caused difficulties in protecting the rights of Kosovo’s civil servants, due to the impossibility of making decisions on the one hand, and the accumulation of a large number of cases, on the other.” Hassan said.

According to Hasan, from October 2020 to October 2021, the Council decided on 40 complaints for termination of employment, of which 11 were approved, 3 were rejected, 22 were rejected, 3 were declared incompetent and 1 is back for reconsideration.

Hasani emphasized that during the period January – October 2021, a total of 178 decisions were brought by the Courts of the Republic of Kosovo for labor disputes, in cases where the parties were state institutions represented by the State Bar. Of all these disputes, 109 disputes were lost by the state institutions, 44 disputes were won, 9 were partially approved, 5 were returned to retrial, 3 were reinstated and in 1 case the lawsuit was dismissed due to lack of competence.

As for the cost of these decisions, according to Hasan, the amount lost from the state budget in relation to the court decisions for termination of the employment relationship brought during the period January – October 2021 in public institutions, exceeded the amount of 300 thousand euros.

“So, this means that more than 300,000 euros have cost the Kosovo budget illegal dismissals from work in public institutions, as well as other decisions related to work in these institutions,” concluded Hasani.

Finally, regarding the findings of this report, the FOL Movement has given the following recommendations:

Termination of the employment relationship of employees by employers must be done in accordance with the provisions of the Kosovo Labor Law and the Law on the Civil Service of Kosovo.

The Ministry of Internal Affairs and Public Administration should create an electronic database in which all cases of dismissals, voluntary departures of workers and disputes from the civil service in central and local administration institutions will be recorded.

Consequently, all central and local government institutions, as well as other bodies, must be obliged to report the data in the electronic database of this institution, in such cases, no later than 1 month from the day of dismissal, removal, or the beginning of the dispute.

Courts of the Republic of Kosovo respect the legal deadlines for handling cases from labor disputes, as well as treat cases from labor relations with priority.

The Ministry of Internal Affairs and Public Administration took concrete steps in order to inform and raise the awareness of the institutions for the protection of the rights of employees.

To increase the supervisory/monitoring function of the Independent Supervisory Council of the Civil Service of Kosovo towards public administration institutions, related to the implementation of the rules and principles of the legislation for the civil service. Consequently, reports related to monitoring findings are regularly published on the KPMShC website.

The courts of Kosovo have published 2168 judgments for the month of January 2022

Pristina, February 18, 2022 – The FOL movement in cooperation with the Debate Center, have continued with the monitoring of verdicts for the year 2022 as well.

During the month of January 2022, the Courts of Kosovo have published 2168 judgments. The Basic Court of Pristina and the Court of Appeal are the courts with the most published verdicts.

This project is supported by the US State Department, through the International Bureau on Narcotics and Rule of Law (INL).

Call for Award: “FOL for procurement”

Prishtinë, 10 FEB 2022 – The FOL movement with the support of the Open Contracting Partnership opens the call for applications for the “FOL for procurement” Award.

The monitoring of public procurement by journalists directly or indirectly will push the relevant institutions to review their work methods in order to be more transparent and responsible in spending public money.

Therefore, to encourage investigative journalism in the field of public procurement, FOL will award three prizes for articles published by investigative journalists in this field who have presented irregularities and abuses through public procurement procedures. The first prize will be 500 euros, the second 300 euros, and the third will be 200 euros.

Who can apply?

Journalists who operate in Kosovo and work as freelancers or are employed by registered media in Kosovo.

The articles must be published for all forms of journalism (print, internet, radio and TV) broadcast in Kosovo media in the official language.

Articles/stories submitted for application must have been published during the calendar year January 1 – December 31, 2021.

Application/nomination procedure:

Apply by sending the article, the publication link and a short bio to the email: [email protected] and write in the subject “Application/nomination for the FOL award for procurement”.

Application deadline: The application submission deadline is 25.02.2022.

Evaluation: The jury of the “FOL for Procurement” Award will consist of media experts and experts in the field of public procurement.

Rrugëtimi i Kosovës drejt BE-së: Sfidat në Drejtësi, Administratë Publike dhe Integrime Evropiane

Prishtinë, 28 janar 2022 – Lëvizja FOL në bashkëpunim me PIPS dhe me mbështetjen e Ambasadës e Mbretërisë së Holandës  në Kosovë ka organizuar sot konferencën një ditore me temën “Rrugëtimi i Kosovës drejt BE-së: Sfidat në Drejtësi, Administratë Publike dhe Integrime Evropiane”.

Mexhide Demolli Nimani – drejtoreshë ekzekutive e Lëvizjes FOL tha se qëllimi i konferencës ishte reflektimi mbi përpjekjet e bëra nga Kosova për zbatimin e drejtë të reformave në drejtësi, administratë publike dhe integrim në Bashkimin Evropian.

Ambasadorja e Mbretërisë së  Holandës në Kosovë, Carin Lobbezoo në fjalën e saj të rastit tha se këto lloje të takimeve na ndihmojnë që të kuptojmë më mirë për atë që po ndodh dhe janë të mirëseardhura. “Integrimi në BE në esencë do të thotë, të japësh për qytetarët e Kosovës, kryerja e reformave, miratimi i legjislacionit dhe zbatimi i të dyjave, është mënyra për ta arritur këtë. Rrugëtimi i Kosovës në BE ka filluar me nënshkrimin e Marrëveshjes për Stabilizim Asociim, dhe më tutje është zgjeruar në mekanizma tjerë si ERA I dhe ERA II. Në këtë panel u nda përvoja e shteteve të anëtarësuara së fundmi në BE duke e parë si kanë vepruar ata në avancimin e një procesi të tillë të integrimit dhe se ku duhet të fokusohen institucionet e Kosovës për të vendosur Kosovën në një pozitë më të favorshme në raport me integrimin në Bashkimin Evropian.

Pristina, January 19, 2022 – The FOL movement continues the series of Open FOL debates with Ministers of Kosovo, where the Minister of Industry, Entrepreneurship and Trade, Mrs. Rosetta Hajdari.

The topic of discussion was the realization of the Government’s Work Plan for 2021, the priorities and the challenges that this ministry is facing.

This discussion was carried out with the support of the MATRA program of the Dutch Embassy in Kosovo and is implemented in cooperation with PIPS.

Minister Aliu to stop the denigrating campaign against activist Shpresa Loshaj

Prishtinë, 3d December 2021 – We, the undersigned, oppose Minister Aliu’s denigrating campaign against activist Shpresa Loshaj and express our deep indignation at his interference with freedom of expression and activism in Kosovo.

On November 22, 2021, the Ministry of Environment published on its Facebook page a text through which it announced that a ‘concept document’ had been compiled for the restoration of the “Zalli i Rupës”. The same day, Ms. Loshaj published a reaction through which she raised serious concerns about the ministry’s approach to the restoration of this area, criticized Minister Aliu for the lack of transparency and for continuing the same policies of previous governments towards the environment.

On November 24, Mr. Aliu organized a press conference through which he launched a denigrating campaign against Ms. Loshaj. By targeting her by name and last name, he accused Ms. Loshaj for defamation, asked her to show ‘caution’ before speaking and gave a lecture at a distance about what causes she should advocate for. Minister Aliu continued the campaign against her in the show “Rubicon” broadcast one day after the conference. This campaign was continued by other officials of the Ministry, such as the case of the Minister’s advisor Lulzim Bauman, who launched similar accusations through comments on the online profile of Ms. Loshaj.

Minister Aliu’s statements are derogatory, contemptuous and threatening, and are intended to reduce the credibility of Ms. Loshaj in the eyes of the public, intimidate her and silence criticism of the Ministry for the decisions it makes. Minister’s ‘instructions’ on what an activist should do are state interference in citizens’ rights to engage freely in topics they consider to be of general interest. Minister Aliu is a powerful politician, one of the most voted people in the country and speaks from his position as head of the Ministry of Environment. It is disturbing that he uses his power and state resources to organize press conferences to intimidate civil society activists, with whom he had worked closely before coming to power.

We consider that the targeting of Ms. Loshaj by Minister Aliu is state intervention in civic activism and violation of freedom of expression. The campaign against Ms. Loshaj is a campaign against all activists in Deçan and Kosovo and other members of civil society who have the courage to engage in sensitive causes of general interest and contribute to improving the environment and life in Kosovo.

Ms. Loshaj is a well-known environmental activist, her work and that of other activists has stopped the degradation of nature in Deçan, for which she has been awarded four prizes.

We ask Minister Aliu to show a high level of tolerance for criticism, to refrain from such statements in the future, to stop the denigrating campaign against Ms. Loshaj and work with full transparency and protect the public interest.

FOL dhe DC vazhdojnë monitorimin e publikimit të aktgjykimeve për të gjitha gjykatat e Kosovës

Prishtinë, 26 nëntor 2021 – Lëvizja FOL në bashkëpunim me Debate Center, janë duke vazhduar me monitorimin e publikimit të aktgjykimeve për të gjitha gjykatat e Kosovës.

Gjatë muajit tetor 2021, Gjykata Themelore e Prishtinës si dhe e Mitrovicës janë gjykatat me më së shumti aktgjykime të publikuara. Në ueb-faqen e Këshillit Gjyqësor të Kosovës janë të publikuara 2544 aktgjykime. Lëvizja FOL ka regjistruar në databazën e saj 2417 aktgjykime. Lëvizja FOL nuk i ka evidentuar aktgjykimet për Kundërvatje, e të cilat janë publikuar nga Gjykata Themelore në Ferizajit si dhe nuk i ka regjistruar aktvendimet, të cilat kanë të bëjnë me konteste martesore, e të cilat janë publikuar nga Gjykata Themelore në Prishtinë.

Ky projekt mbështetet nga Departamenti i Shtetit Amerikan, përmes Byrosë së Narkotikëve Ndërkombëtar dhe Çështjeve të Zbatimit të Ligjit (INL).

 

The Ad-Hoc Commission for the selection of candidates for RTK Board members selects 18 candidates for voting in the Assembly

Prishtinë, 18 nëntor 2022 – The Ad-Hoc Committee for the selection of candidates for Board members for RTK has completed the interview of 91 candidates out of 132 candidates who applied.

This was one of the largest recruitment processes that the Assembly of Kosovo had undertaken so far, due to the large number of candidates who had applied.

From our monitoring, it appears that this process has gone correctly and all the members of the Commission have shown cooperation with civil society.

It is also worth emphasizing the transparency of this entire process, making the scoring of the candidates to be done in the presence of civil society monitors.

FOL has welcomed that the Ad-Hoc Commission has decided to respect the Law on Gender Equality in this process, by sending a list with equal composition of women and men candidates to the Assembly for voting.

In the short list that goes to the Assembly, there are 16 Albanian candidates, of which 8 women and 8 men and 2 candidates (one man and one woman) from the Serbian community.

It is worth noting that the Ad-Hoc commission, since the beginning of this process, has been working towards making the recruitment process for the RTK Board based on meritocracy.

FOL appealed to the deputies of the Assembly of the Republic of Kosovo to respect the Law on Gender Equality during the voting of the candidates, so that the RTK Board has equal gender representation.

Implementation of the Government Work Plan for the period March-September 2021

FOL and DC continue to monitor the publication of judgments for all Kosovo courts

Pristina, October 29, 2021 – The FOL Movement in cooperation with the Debate Center, are continuing with the monitoring of the publication of judgments for all Kosovo courts.

The courts of Kosovo during the month of September 2021 have published 2736 judgments on the web-portal of the Judicial Council of Kosovo. This project is supported by the US Department of State, through the Bureau of International Narcotics and Law Enforcement Affairs (INL).

 

 

FOL Hapur with the Minister of the Ministry of Education and Culture, Mr. Faton Peci

Pristina, October 27, 2021 – The FOL movement continues the series of Open FOL debates with Ministers of Kosovo, where today the next guest was the Minister of Agriculture, Forestry and Rural Development Mr. Faton Peci. The topic of discussion was the realization of the Government’s Work Plan for the period March-September 2021, the priorities and the challenges that this ministry is facing.

This discussion was carried out with the support of the MATRA program of the Dutch Embassy in Kosovo and is implemented in cooperation with PIPS.
